DONATION WEBSITE TERMS AND CONDITIONS OF USE


Please read these terms and conditions of use (these “Conditions”) carefully. By accessing and using this donation website owned or operated by us (the “Donation Website”) through chc.org.sg, citynews.sg, cityparents.sg, cityradio.sg, citytv.sg, crossover.sg, emerge.sg, harvestkidz.sg, as well as all other domain names owned or controlled by CHC, or any of its affiliates and/or subsidiaries or accessing and using our online services (our “Website”) and the City Harvest mobile application (the “App”), you will be conclusively presumed to have notice of, and you acknowledge that you agree to comply with and be bound by these Conditions, as amended from time to time. These Conditions govern our relationship with you in relation to our Donation Website. If you disagree with any part of these Conditions, you must immediately discontinue your access or use of our Donation Website.

Our General Terms and Conditions of Use of our Website and/or App found at https://www.chc.org.sg/terms (the "General Terms and Conditions of Use") may be applicable to sections of our Donation Website. Such General Terms and Conditions of Use shall constitute a part of these Conditions. In the event of any conflict between such General Terms and Conditions of Use and these Conditions, these Conditions shall prevail to the extent of such conflict.

The terms “City Harvest Church”, “CHC”, “we” or “us” refer to City Harvest Church and its affiliates (where applicable), and the term ‘our’ has a correlative meaning. The term “you” refers to the viewer or user of our Donation Website, and the term ‘your’ has a correlative meaning.

Headings are inserted for convenience and shall not affect the interpretation of these Conditions.

  1. Account Registration Certain functionalities of our Donation Website may only be used or accessed if you have a registered account with us (a “User Account”). The process of setting up a User Account can be found at our General Terms and Conditions. Such functionalities include but are not limited to:
    1. Tracking of donations made via the Donation Website;
    2. Download transaction receipts; and
    3. Update your personal particulars.
  2. Use of Donations
    1. You acknowledge and agree that all donations made through the Donation Website may be used by us, in our sole and absolute discretion, for purposes such as:
      1. Supporting our General Fund, which includes but is not limited to the conduct and administration of our weekly worship services, and to be involved in missions by the sending out, receiving and training of missionaries and the planting of branch churches both in Singapore and overseas, as well as any other activities which are conductive or incidental to the attainment of the vision, mission and objects of CHC; and
      2. Supporting our Building Fund (including but not limited to the acquisition, construction, development, maintenance, lease and use of buildings and other real estate including the rental or purchase of equipment and furnishings, fees of service providers and building management fees for various activities conducted by us, whether to your benefit or otherwise).
    2. We reserve the right, in our sole and absolute discretion, to reject and/or refund any donation where the donation cannot be accommodated by the purposes set out above, or where the acceptance of the donation presents a reputational risk to us. For the avoidance of doubt, in the event where we discover and/or suspect any attempts at illegal activities (such as money laundering and/or the financing of crime or terrorism) through donations made through our Donation Website, we will report such attempts to the relevant authorities.
  3. Donations and Payments
    1. You acknowledge that all donations made through the Donation Website and any other types of Payments made through the Website and/or App are processed by our payment gateway provider. While we have in place adequate control measures and safeguards to ensure proper accountability and to prevent any loss or theft of donations, you acknowledge that we are not responsible for the processing of donations and payments made through the Donation Portal. Such processing includes, but is not limited to, the issuance of receipts to you for donations and payments made through our Donation Website and the processing of credit card transactions made through our Donation Website.
    2. City Harvest Community Services Association (“CHCSA”) has authorized and appointed CHC to accept the charitable donations from members of the congregation at CHC services every weekend at the church’s premises and via the Donation Website on behalf of CHCSA. In making a donation to CHCSA via the Donation Website, you agree that:
      1. CHC shall provide your personal information to CHCSA, for the purposes of recording your donation details. CHCSA has its Privacy Policy which details how your personal data is managed.
      2. CHCSA will issue tax-deductible receipts for donations amounts of SGD 50 or more. The tax deductions for donations will be given to you by the Inland Revenue Authority of Singapore, in line with their prevailing rates.
      3. Any and all Donations collected on behalf of CHCSA shall be used by CHCSA in its sole discretion and CHC shall be under no obligation to monitor the use of the same.
    3. You shall examine all entries in the transaction history relating to donations made by you via the Donation Website (“Transaction History”) which can be found on your User Account (if you have registered one with us). You must report any donations wrongly made or made without authority or inaccurate entries in the Transaction History. You must object to any donations or any other inaccuracies in writing to us at donation@chc.org.sg after the entry appears in the Transaction History. If you do not do so, the donations will be deemed correct and conclusive and are non-refundable in nature. We will be free from all claims in respect of any and every donation shown in the Transaction History for which no objection has been made in accordance with this clause.
    4. Save as provided in clauses 2.2, you hereby acknowledge that all donations made through the Donation Website are non-refundable in nature. You irrevocably warrant, undertake and represent that all donations made by you through our Donation Website are made on a voluntary basis.
  4. Disclaimers and Exclusion of Liability

    We will not be liable for any direct, indirect, consequential, incidental, special or punitive loss, damage, claim, or liability including, but not limited to, loss of data, profits, business contracts or business opportunities, whether in contract, tort (including negligence) or otherwise arising from your use and/or access of our Donation Website.
  5. Indemnity

    You irrevocably and unconditionally agree and undertake that you shall be liable to and shall indemnify us against any liabilities, costs, expenses, damages and losses (including but not limited to any direct, indirect, consequential loss, loss of profits, reputation, interest, legal and other professional costs and expenses) suffered by us in connection with or arising from:
    1. your access and/or use of our Donation Website;
    2. any other party's access of our Donation Website using your User Account;
    3. your breach of any of these Conditions; and/or
    4. any other party's breach of any of these Conditions where such party was able to access our Donation Website by using your User Account.
  6. Privacy Policy
    1. Our Personal Data Protection Policy sets out our policy concerning the collection, use and disclosure of your personal data in compliance with the Personal Data Protection Act 2012 (No. 26 of 2012) By using our Donation Website, you consent and agree to our collection, use and disclosure of your personal data in the manner set out in our Personal Data Protection Policy, and you warrant that all data provided by you is accurate. Should you wish to update your personal data or should you have any feedback or enquiries relating to your personal data, please contact our Data Protection Officer at dpo@chc.org.sg. Should you wish to withdraw your consent to our collection, use and disclosure of your personal data, you shall undertake at your own expense and risk to uninstall and cease to make use of our Donation Website promptly and immediately.
    2. Please note that if you have a User Account with us, you may not “opt-out” of receiving User Account related emails from us. You may, however, opt-out of receiving marketing emails from us via the unsubscribe feature found in every marketing email.
  7. Violations of these Conditions

    We reserve the right, in our absolute discretion, to monitor any and all access and use of our Donation Portal. We reserve our right to terminate your access and/or use of our Donation Portal or any part thereof and we may block access from a particular internet protocol address to our Donation Website or any part thereof in the event of any violation of these Conditions. In addition, we reserve the right to seek all remedies available under these Conditions, at law and in equity for violations of these Conditions.
  8. Changes to these Conditions

    We may, from time to time and at any time, update or revise these Conditions. Such update or revision is effective upon publication on our Donation Website. You are responsible for ensuring that you have read the most current version of these Conditions. Your continued access and/or use of our Donation Portal will be deemed to constitute your conclusive acceptance of the updated or revised Conditions.

  10. Severability

    If any provision of these Conditions, in whole or in part, is held to be illegal, invalid or unenforceable under any enactment or rule of law or by any court in any jurisdiction: (i) such provision or part will, to that extent, be deemed not to form part of these Conditions, but the legality, validity and enforceability of the remainder of these Conditions is not affected; and (ii) the legality, validity and enforceability of that or any other provision or part under any other jurisdiction will not be affected.
  11. Governing Law and Jurisdiction

    These Conditions shall be governed by, and construed in accordance with, the laws of Singapore. You agree to submit to the non-exclusive jurisdiction of the Singapore courts.
  12. English Version to Prevail

    Should there be any discrepancy between the Chinese and English versions of the Donation Website or these Conditions, the English version will prevail.
